Customer Agreement

By creating an account, you authorize The Elusive List to book reservations on your behalf using the name, phone number, and email address you provideReservations are made in your real name on third-party platforms (Resy, OpenTable, Tock, SevenRooms) or by phone with the venue directly. The reservation belongs to you. We charge for the work of placing it, not for the reservation itself. We may cancel reservations only at your request. The reservation platform sends confirmation directly to you; we never have access to your reservation after it's placed. By submitting a request, you acknowledge that you are responsible for showing up to the reservation in your real name. If we cannot secure the reservation, your card is not charged.

Reservation-platform credentialsFor certain platforms, we may ask you to provide your login credentials so the reservation can be placed in your name on your account. We store those credentials encrypted at rest, use them only to place reservations you've requested, and delete them immediately when you revoke them at /account/credentials. Until you provide credentials, no reservation can be placed on platforms that require your account.

Account standing on third-party platformsBooking on your own platform account may, in rare cases, cause the platform to flag, restrict, or suspend your account. If this happens, we will help you appeal to the platform. We cannot guarantee that the platform will reinstate an account they choose to suspend.

PricingMembership is $1,000 per year, billed annually; you may cancel any time before renewal. As a member you pay reduced per-reservation fees of $50 for Tier I, $100 for Tier II, $225 for Tier III, and $700 for Tier IV. Non-members pay $150, $375, $675, and $1,750 at the same tiers. Per-reservation fees are charged only on successful confirmation of the requested reservation.

Refund policyPer-reservation fees: if we cannot secure the reservation, you are not charged. If we secure the reservation and you cancel more than 24 hours before the reservation time, the per-reservation fee is fully refundable. Cancellations within 24 hours of the reservation are non-refundable. Annual membership: refundable in full if cancelled within 30 days of payment; after 30 days the annual membership fee is non-refundable, but you retain member pricing through the end of the billing year.

Reservation responsibilityYou are responsible for arriving at the reservation in your real name at the scheduled time. Many restaurants charge no-show or late-cancellation fees directly to the card on file with that restaurant; we do not control or collect those fees. Three or more no-shows in any rolling 90-day window may result in suspension or termination of your Elusive List account.

Governing lawThis agreement is governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or related to this agreement will be resolved exclusively in the state or federal courts located in New Castle County, Delaware. By accepting this agreement, you consent to the personal jurisdiction of those courts.
